Q:   Can foreigners own land in Mexico?
A:     Yes, a title is assigned to a Mexican bank trust in your name (fideicomision) for fifty years, renewable upon expiration.



Q:  Renewable upon 50 years?   How is this secured?
A:   
The holder of the trust has the priority to renew, this is guaranteed in the trust contract.



Q:   Is it possible to get obtain title insurance from a U.S. company to safeguard my investment?
A:    Yes, many U.S. companies underwrite land in Mexico.

 

Q:  Can I obtain my land  through a bank that is linked to an American bank?
A:    Yes, many  Mexican banks are affiliated with international banks and operate as one corporation or two linked corporations.  There are Mexican banks that are affiliated with European and American banks.  





Q:  Who should be involved in a real estate transaction.?
A:  1.  A real estate company
         2. The buyers lawyer
         3.  A public notary
         4.  A bank



Q:   What does a Mexican attorney charge to finalize the trust?
A:    Generally between 1,000 to 3,000 U. S. dollars per contract.    

 
 


Q:   I've heard you need a Mexican partner to obtain land?
A:     The North American Free Trade Agreement ( NAFTA) and the Foreign Investment law (FIL) have lifted bans on foreign ownership of land in Mexico.  You no longer need a partner to obtain a land trust.  



Q:  How long can foreigners stay in Mexico?
A:    U.S. visitors can stay for 30 days and apply for  another 30 days as a tourist in mexico.



Q:  If I want to live and work there what do I need to do ?
A:   Apply for a Mexican green card, which permits employment and residency.



Q:  If I apply for a Mexican green card do I have to give up my American passport ?
A:   No, Mexico permits double nationality.





Q:  I've heard it helps to start a Mexican corporation, what does that entail?
A:  1. Three possible names for the corporation.
         2. Two people (both can be foreigners or not)
         3. ID copy
         4.  Cost 1000 usd.  ( for notary and lawyer)



Q:  What are the benefits of starting a Mexican corporation?
A:   1.  You can work, trade or do any business in Mexico as if you were a Mexican citizen.
         2. You can link the  Mexican corporation with your  international corporation for tax reductions.
         3.  The corporation can own land with no land trust in the middle.  

  

Q:   Is this an intentional community, will there be meetings,  co-ownership etc..?
A:     Each family decides what is right for them, there are no regular meetings or co-ownership.

 

Q:  Are there building restrictions?
A:   There are building guidelines, please refer to the eco-infrastructure section for detailed information.

 

Q:   What are property taxes?
A:   Property taxes are  $40,  per hectare,  per year.

 

Q:  Can  we subdivide our land?
A:   It depends on the size of your parcel.   There is a  low density limit of two homes per hectare (2.2 acres).    The smallest parcels at Beyax are 3 hectares ( 6.6 acres)

 

Q:  Can  more than one name or family be on the title?
A:   Yes,  you can have as many names as you like on title.

 

Q:  Is there electricity?
A:    Eco electricity is permitted at Beyax, solar  and wind.  please visit the eco infrastructure section for more information.

 

Q:   Is there drinking water?
A:   There is abundant underground drinking water .      Most people drill wells.

 

Q:   Does everyone have to drill their own well?
A:   Yes, or  you can also gather with your neighbors and share the same well.



Q:  How much does it cost to drill a well?
A:   The cost is approximately 700 usd.
